Defining Personal Injury

Personal injury is a general term used to describe a claim where an individual has been harmed by the negligence, recklessness or intentional act of someone else. A personal injury claim can include injuries resulting from car accidents, defective products and premises liability caused by unsafe buildings and environments. There are many more examples of personal injury claims but the three mentioned are the most common types of claims we see.

While reckless and intentional behavior can give rise to a personal injury claim, most personal injury claims stem from negligence. Negligence is the failure to exercise reasonable care under the circumstances. Reasonable care is measured by how an ordinary prudent person would have acted in those same circumstances.

Using a car accident as an example, an ordinary prudent person wouldn’t rear-end a stopped vehicle. This is a clear example of negligence by the driver who fails to stop. Of course, whether an individual was negligent is not always as clear-cut as the rear-end example, and Oregon negligence law does have some nuances. A lot of cases require at least a small degree of investigation to determine whether the harm was caused by negligence.
